1. Acceptance of Terms
By downloading, installing, or using the SideQuest mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and SideQuest, Inc. ("we," "our," or "us").
2. Description of Service
SideQuest is a location-based quest discovery and completion platform. Users discover real-world challenges ("quests") near their location, complete them through physical activity and exploration, verify completion with photos and GPS data, and earn experience points (XP), badges, and other virtual rewards.
3. Account Registration
To use SideQuest, you must:
- Be at least 13 years of age
- Create an account using Apple Sign In or Google Sign In
- Provide accurate and complete information during registration and onboarding
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
You are responsible for all activity that occurs under your account.
4. User Conduct
When using SideQuest, you agree not to:
- Submit fraudulent quest completions or fake verification data
- Use GPS spoofing, location manipulation, or any tools to falsify your location
- Harass, bully, or threaten other users
- Upload inappropriate, offensive, or illegal content as quest verification photos
- Trespass on private property or enter restricted areas to complete quests
- Use the App for any illegal purpose or in violation of local, state, or federal laws
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's infrastructure or other users' experience
- Create multiple accounts to manipulate leaderboards or rewards
5. Quest Safety
SideQuest provides quest suggestions for entertainment and exploration purposes. By participating in quests, you acknowledge and agree that:
- You assume full responsibility for your safety when completing quests
- You should exercise reasonable judgment and awareness of your surroundings
- You should not attempt quests that put you in danger or require illegal activity
- You should obey all traffic laws, property boundaries, and local regulations
- We are not responsible for injuries, property damage, or other harm that may occur during quest completion
- Weather, terrain, and other environmental conditions are your responsibility to assess
6. User Content
When you submit content to SideQuest (including quest verification photos, profile information, and ratings), you:
- Retain ownership of your content
- Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App and for promotional purposes
- Represent that you have the right to submit the content and that it does not infringe on any third party's rights
- Acknowledge that we may remove content that violates these Terms at our sole discretion
7. Intellectual Property
The SideQuest App, including its design, code, Scout mascot, branding, icons, and all related intellectual property, is owned by SideQuest, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on SideQuest without our express written permission.
8. Virtual Rewards
Experience points (XP), badges, streaks, leaderboard rankings, and other virtual rewards earned through the App:
- Have no monetary value and cannot be exchanged for real currency
- Are non-transferable between accounts
- May be adjusted, modified, or reset at our discretion for maintenance, balancing, or policy enforcement purposes
- Do not constitute property rights
9. Privacy
Your use of SideQuest is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.
10. Disclaimer of Warranties
SideQuest is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or usefulness of any quest information, location data, or user-generated content.
11. Limitation of Liability
To the maximum extent permitted by law, SideQuest, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of SideQuest. Our total liability for any claims arising from or related to the App shall not exceed the greater of (a) $100 USD or (b) the total amount you have paid us in the 12 months preceding the claim.
12. Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, including but not limited to:
- Violation of these Terms of Service
- Fraudulent activity or abuse of the quest system
- Harassment of other users
- Extended period of inactivity
You may delete your account at any time through the App settings or by contacting us. Upon termination, your right to use the App ceases immediately, and your data will be handled according to our Privacy Policy.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of SideQuest shall be resolved in the courts located in Palm Beach County, Florida.
14. Changes to Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. We will notify you of material changes through an in-app notification. Your continued use of SideQuest after changes are posted constitutes acceptance of the updated Terms.
